CQS/FV – Cesnik, Quintino, Salinas, Fittipaldi and Valerio Advogados expands its portfolio and starts operating, as of June, in the area of White Collar Crime Law.
The new department is part of the expansion project that began with the entry of partners José Maurício Fittipaldi, Ygor Valerio and Felipe Senna in December 2020, when the office also changed its name and started to have a stronger presence in the technology sector.
According to the founding partner, Fabio Cesnik, “the office has always grown in an orderly manner, with a focus on the clients’ needs. And, without a doubt, the creation of the White Collar Crime Law area reflects this moment and is part of a movement that accompanies the media, entertainment and technology sectors with the recent changes in the market that we have been following”.
The entire production chain of these sectors has adapted very quickly to the new reality, with national and international players migrating to streaming services, video on demand (VoD), internet of things (IoT), wearables, digital wallets, new payment methods and other disruptive technologies.
This new scenario requires a strong legal structure capable of meeting this complexity. This also brings new challenges, such as digital crimes including piracy, online fraud, phishing, leaks, kidnapping and data theft, among others, as well as issues related to the new General Data Protection Law (LGPD). It is estimated that digital crimes cause billions in losses to companies.
Ygor Valerio, partner responsible for the new practice, reinforces that “this is the exact moment to launch the area, considering that we were already serving clients in digital crimes and other related cases, such as combating digital piracy”.
Felipe Senna adds that “the CQS/FV is not a beginner in criminal law, but restricted its performance to specific demands from clients who knew more closely about our performance in this area. Now, we will start to offer a robust service, which is already born with experience in complex cases of relevant criminal aspects”.
In addition to the work focused on digital crimes, the office also expanded its activities in general criminal law, with the hiring of criminalist Marjori Ferrari.
The team adds extensive expertise in the area of media and technology to the technical knowledge of the market to offer unparalleled advice in combating cybercrime and piracy in both consultative and contentious cases, acting both preventively and reactively, in addition to structuring and implementing projects , adaptations to legislation, monitoring of inspection and support to investigative police operations.
YGOR VALERIO has a postgraduate degree in Intellectual Property from FGV/SP, deputy secretary of the Copyright Commission of the Federal Council of the OAB and Co-coordinator of the Copyright Study Commission of the Associação Brasileira da Propriedade Intelectual (ABPI), in addition to Titular Adviser of the Conselho Nacional de Combate à Pirataria do Ministério da Justiça (CNCP) from 2015 to 2020. Highly experienced in the audiovisual and technology sectors, he has 15 years of experience in the legal departments of large companies such as Adobe, Microsoft, Nokia and institutions including Motion Picture Association (MPA) and Antpirataria Cinema e Música (APCM).
FELIPE SENNA is a member of the Antipiracy Committee of ANCINE (Agência Nacional do Cinema), member of the board of the Associação Brasileira de Televisão por Assinatura (ABTA), of the antipiracy committee of the OAB/SP and of the Alianza Contra La Pirateria de Televisión Paga. With 16 years of career, he directed the anti-piracy area of Fox Networks and Sky Brasil. He specializes in Intellectual Property, including software production, licensing and protection. Master (LL.M.) from the Beasley School of Law, Temple University Japan Campus, focusing on Intellectual Property, Content Protection and Technology; LL.M. in Business Law from FGV and a postgraduate degree in cybercrime and electronic contracts from OAB.
MARJORI FERRARI is a criminal lawyer with solid experience of over 15 years working both in advisory and litigation claims in recognized law firms such as David Rechulski Advogados and D’Urso e Borges Advogados. She holds a postgraduate degree in Economic Criminal Law from the Institute of Economic and European Criminal Law (IDPEE) of the Faculty of Law of the University of Coimbra in partnership with the Instituto Brasileiro de Ciências Criminais (IBCCRIM), in Criminal Procedural Law from the Faculdade Autônoma de Direito de São Paulo (FADISP) and in Criminal Law by the Superior School of the Escola Superior do Ministério
Público de São Paulo (ESMP/SP).
The new White Collar Crime Law area will work in synergy with the other areas of the firm, offering the same capacity and excellence that are characteristic of CQS/FV Advogados. “The potential of the area is so great that we already have several demands for new cases, even before the area is formalized for the market” completes Ygor Valerio.
